Privacy Policy

Ashkon Software L.L.C. ("Ashkon Software", "we", "us" or "our"), a Washington limited liability company, operates FilesLand.com and publishes the software available on it (the "Software"). This Privacy Policy explains what information we collect when you visit our web site, buy or use our Software, or contact us, and how we use and protect it.

"Personal Information" means information that identifies, or can reasonably be linked to, an individual, such as a name, postal address, e-mail address or IP address.

1. INFORMATION WE COLLECT

Information you give us. When you use our feedback or support form, or e-mail us, we receive the information you provide, such as your e-mail address, the product you are asking about, and the content of your message.

Purchases. Orders are processed by PayPal. When you buy a license, PayPal shares with us the details we need to complete the order and deliver your registration key, such as your name, e-mail address, billing or shipping address, the product purchased and the transaction details. We do not receive or store your credit card or bank account numbers. Your use of PayPal is governed by PayPal's Privacy Statement.

Information collected automatically. Like most web sites, our web server automatically records standard log information for each request, including your IP address, browser type and version, operating system, referring page, the pages or files requested and the date and time. When you submit the feedback form, your IP address and browser information are included with your message so that we can prevent abuse, and a one-way hash of your IP address is kept briefly to limit the number of messages that can be sent.

Cookies. Our use of cookies is described in our Cookie Policy.

2. OUR SOFTWARE

Our Software does not send your files, e-mail, documents or other personal content to Ashkon Software. Some features connect to third-party internet services in order to work — for example to download market quotes, resolve host names, look up WHOIS / RDAP and network ownership information, or determine your public IP address. When these features are used, the third-party service receives your IP address and the request being made, and handles it under its own privacy policy. Ashkon Software does not control those services.

3. HOW WE USE INFORMATION

We use the information we collect to:

  • process orders and deliver, restore and verify registration keys;
  • answer your questions and provide technical support;
  • operate, maintain, secure and improve our web site and Software;
  • detect and prevent fraud, spam, abuse and unauthorized use;
  • keep business, tax and accounting records; and
  • comply with legal obligations and enforce our terms, including our Disclaimer.

We do not use your information for automated decision-making that produces legal or similarly significant effects on you.

4. HOW WE SHARE INFORMATION

We do not sell or rent your Personal Information, and we do not share it for cross-context behavioral advertising. We share it only:

  • with service providers who act on our behalf, such as our payment processor, web hosting and e-mail providers, and who are permitted to use it only to provide their services to us;
  • when required by law, subpoena or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights, property or safety, or that of our users or others;
  • in connection with a merger, acquisition, sale of assets or similar transaction, in which case the information will remain subject to this Privacy Policy; or
  • with your consent.

5. INTERNATIONAL TRANSFERS

Ashkon Software is based in the United States, and your information is processed and stored in the United States and in other countries where our service providers operate. These countries may have data protection laws that differ from those of your country. By using our web site or Software, you understand that your information will be transferred to and processed in these countries.

6. DATA RETENTION

We keep Personal Information only as long as reasonably necessary for the purposes described in this policy. Order records are kept for as long as needed to support your license and to meet tax and accounting requirements. Support correspondence is kept while it is useful for answering your questions. Web server logs are kept for a limited period for security and troubleshooting, and are then deleted.

7. SECURITY

We take reasonable administrative and technical measures to protect your information, including encrypted (HTTPS) connections to our web site. However, no method of transmission over the internet or of electronic storage is completely secure, and we cannot guarantee absolute security.

8. YOUR CHOICES AND RIGHTS

You may choose not to provide Personal Information; you can still browse our web site and download trial versions of our Software without doing so, but we may be unable to process an order or answer a support request.

Depending on where you live, including California, Washington and other U.S. states, the European Economic Area, the United Kingdom and Canada, you may have the right to request access to, correction of, deletion of, or a copy of the Personal Information we hold about you, and to object to or restrict certain processing. To make a request, contact us as described below. We may need to verify your identity before responding, and we may retain information where the law requires or permits us to. We will not discriminate against you for exercising any of these rights. If you are in the EEA or UK, you also have the right to lodge a complaint with your local data protection authority.

9. CHILDREN'S PRIVACY

Our web site and Software are not directed to children, and we do not knowingly collect Personal Information from anyone under 13 years of age (or under 16 in the EEA and UK). If you believe a child has provided us with Personal Information, please contact us and we will delete it.

10. THIRD-PARTY WEB SITES

Our web site and Software may contain links to, or connect to, web sites and services operated by others, including PayPal. We are not responsible for the privacy practices of those third parties, and we encourage you to read their privacy policies.

11. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time by posting the revised version on this page with a new "Last updated" date. Your continued use of our web site or Software after the change is posted means you accept the revised policy.
